Tajik citizen demands punishment of a rapist judge of her minor daughter

A resident of the capital of Tajikistan through social networks appealed to the President of Tajikistan and the General Prosecutor’s Office with a request to help to punish the rapist of his minor daughter. We provide the text of the appeal with minimal, just editorial changes.

“I am a resident of Dushanbe. My address is 114, N. Karabaeva street. I am married. I am an ordinary taxi driver. Former judge of Sogd regional court Alimshoev Pirakhmad and his wife Saodat Turaeva, a former employee of the Ministry of Internal Affairs illegally seized two hundred square meters of land near their house. But the purpose of my appeal is not to talk about the seized land.

The fact is that Alimshoev Pirakhmad invites girls and boys of 10-11 years old in his garden, gives them money or buys ice cream, and they collect garbage from his garden, then play there.

He also invited my 10-year-old daughter, Shukrona Maksudova, to his basement, took off her clothes, he also undressed and committed an act of sexual violence. According to my daughter, Alimshoev Pirakhmad did such actions in his basement from May to July 2019.

The last date was July 25, 2019. She was afraid of him, and didn’t want to visit him. But when she didn’t come, he always threatened “If you tell your parents or anyone else about these things, I will kill you and throw into the river, and no one will find you”. We learned about this only when our daughter told the neighbor’s girl, and the neighbor told my wife. I can’t even describe my wife’s condition.

I addressed to the Department of Internal Affairs of Firdavsi district of Dushanbe. According to the Article 139 (the Part 4) of the Paragraph of the Criminal Code of the Republic of Tajikistan, that is, the commission of an act of sexual violence against a person under the age of 14 is subject to criminal punishment from 15 to 20 years. However, the city Prosecutor’s Office took the case and changed the Article from 139 Part 4 (a) to the Article 142 Part 2 (Lecherous actions) of the Criminal Code of the Republic of Tajikistan, which provides for a punishment of imprisonment of 2 to 5 years.

My rights and those of my minor child were grossly violated. My financial situation is not stable, and I didn’t have the opportunity to pay for a lawyer to protect my own child.

I believed in our authorities, and I thought that according to the Law the perpetrator would be punished, but the city Prosecutor’s office strongly supported him. I addressed to the media, but they are also afraid.

The criminal case of Alimshoev Pirakhmad is currently referred to the court of Firdavsi district of Dushanbe.

I beg the General Prosecutor’s Office to request the case of Alimshoev Pirakhmad. The city Prosecutor’s office said that there was no rape, the defendant only satisfied his sexual needs.

I ask the President of the Republic of Tajikistan, the chairmen of both chambers of the Parliament of Tajikistan to take control of the case.”
