Relatives of the top officials of Kyrgyzstan are involved in the murder of the prosecutor

The trial of the murder of the prosecutor of Batken region (Kyrgyzstan), which began in May of this year, turns into a scandal. The case involves relatives of the top officials of the country, and in the dock there is a man who fought with their corruption frauds.

 Last November, the murdered prosecutor Anarbai Mamazhakypov, two of his deputies and the Head of the capital construction department of Batken region, Melis Kalykov, went hunting. They all drank, and according to the official version of the prosecution, later Melis Kalykov shot the prosecutor. Moreover, the testimony of witnesses in this case during the trial is constantly changing. At first they said that the murdered prosecutor and his killer had left together in an unknown direction. Later, a version appeared that Kalykov took the prosecutor hostage.

The defendant Kalykov himself does not admit his guilt, and claims cruel torture against him. According to his lawyer, the courts refuse to consider his client’s allegation of torture. The sister of the accused, Damira Kalykova, earlier also appealed to the President and the Prosecutor General of the country with a request to step in because of the use of torture against witnesses in this case.

“When my brother was run in, the fact of the detention was not documented for another one and a half days. He said that 9 people tortured him. This happened for 20 hours; he was forced a confession. He didn’t confess to a crime, did not sign anything, but the Prosecutor’s office falsified the confession,” the woman says.

She said that police officers sympathizing with Melis Kalykov made a copy of the sheets from the Crime Registration book. These notes confirm the illegal actions of law enforcement agencies.

“In this journal, they wrote in retrospect that my brother had an accident and he was brought to the police. However, there was no accident. Lexus of our friend, mentioned in this book, was safe and sound at the impound,” says Damira Kalykova.

Another oddity of this case is that the trial was entrusted to a judge who is under investigation in other criminal cases. Relatives of the defendant have already challenged the judge five times.

“We have the letter that confirms that three criminal cases have been opened against the judge Kudayarov. They are not closed until now. However, as far as we know, Kudayarov wanted to recuse himself from the case, but he wasn’t allowed; he has to condemn my brother. There was another judge before that, but he dissociated himself. No one wants to get involved in this case,” the accused’s sister Damira Kalykova said in an interview with ACCA.

According to her, the reason, why judges with a more or less pure reputation avoid the murder of the prosecutor, lies in the fact that relatives of very influential people appear in it.

“Aslan Baybosunov, the Deputy of the murdered, who was there on the day of the hunt, is a relative of Prime Minister Mukhamedkaliya Abylgaziev. Another Deputy prosecutor who was also present at the hunt, Emilbek Azhibekov, according to media reports, is the nephew of incumbent President Sooronbai Jeenbekov,” said Kalykova. “There are many inconsistencies in this case. For example, all participants in that tragedy claim to have returned to Batken at seven in the evening. However, data from mobile communication towers show that the mobile phones of everyone, who was with the deceased that day, were in the same area until 10-11 o’clock in the evening. They were not in the regional center, as they say,” says Kalykova.

The woman also sees the discrepancy in the statement that Melis, in a drunken stupor, took Mamazhakypov hostage, and then killed him on a deserted road.

“The late prosecutor was taller than my brother. He took special training and regularly went in for sports. My brother just physically couldn’t do it! Even if we assume that he could cope with Mamazhakypov, why didn’t the others try to stop him? They were all armed,” the accused’s sister wonders.

According to the woman, Kalykov’s lawyers managed to detect other contradictions in the materials of the resonant case.

“At the place where the corpse was discovered, signs of a fight were visible within a radius of 25 meters. Mamazhakypov’s teeth were found there, as well as traces of at least three people. We learned about this only at the trial, the investigation hid this fact. In addition, it turned out that the body of the deceased was dragged from the main road to the road, where rarely is anyone. Traces of blood (drops) remained on the earth. Although, if my brother had moved the corpse, then a quite big bloody trace would have remained, and the soil would have been subsided. This allows us to make the assumption that at least 2 people were carrying Mamazhakypov’s body,” the sister of the defendant thinks.

According to Damira Kalykova, there are also discrepancies in the results of medical and ballistic examinations.

“Research says completely different things. Most probably, this is due to corruption. One examination claimed that everyone was completely sober, except my brother, another that everyone was drunk. A ballistic examination revealed that Mamazhakypov was not killed from the rifle of Melis; he has a 20-caliber rifle,” the woman says.

According to her, her brother’s lawyer conducted an investigative experiment, and found out that if you shoot from a 20-caliber rifle from the distance that is mentioned in the case, then nothing will remain of the human brain.

“However, Mamazhakypov’s brain was practically intact. Investigators hide a lot of facts, exposing only those that fit into the version convenient for them,” says Kalykova.

During the trial, it also became clear that one of the deputies of the murdered prosecutor had 4 firearms with him on the day of the hunt, however, he gave only 3 of them to a ballistic examination.

The sister of the defendant believes that behind the murder of the prosecutor and persistent attempts to lock up her brother for this crime, there is an organized criminal group, which includes law enforcement officials.

“They chose victims and extorted money from them. The scheme was as follows: a certain “expert” comes to the Head of a government agency or department and reports that there are some violations. Next comes blackmail, with the promise of trouble from the regional and district prosecutors. And they can’t be paid off. In the case of my brother, such an “expert” (Abdylda Ulukov) was involved. This man, according to my brother, came to rural schools, began to conduct an illegal inspection and promised trouble. Such an inspection is illegal for the reason that any event of this kind should not take place without the consent of the Capital Construction Department of the region, which was headed by my brother. Naturally, after such a check, people called my brother, who did not know what was happening,” Kalykova explains.

She claims that Melis Kalykov, faced with lawlessness, made an oral complaint to the now murdered regional prosecutor Anarbay Mamazhakypov. At that time, Mamazhakypov had been working in Batken for several months.

“The regional prosecutor replied that this is not the first time he has heard such a complaint. Earlier, civil activists such as Rosa Mamanova appealed to him. As a result, he said that he could only help if there was an official statement. My brother wrote a formal complaint about unauthorized checks. After that, my brother got into trouble. They came from Mamazhakypov’s deputies – Aslan Baybosunov and others. The regional prosecutor promised my brother that he would help, but didn’t have time,” the woman says.
