Kyrgyzstan: the courts granted the motion for the arrest of persons under investigation in 67.8% of cases

A member of the Coalition against Torture in Kyrgyzstan “Human Rights Advocate Center” monitored the court hearings for the legality and justification of detention and the application of a preventive measure.

The purpose of the monitoring is to determine the degree of compliance with the practice of investigative judges of the Kyrgyz Republic in exercising judicial control over the legality and justification of detention and the application of a preventive measure to the principles of Habeas corpus and international standards of a fair trial.

The monitoring results showed that in 90.8% of cases, prosecutors asked to choose a measure of restraint for the defendants in the form of imprisonment. In 67.8%, the courts granted the petitions of the prosecutors.

“Only in 9.2% of cases, prosecutors asked to apply a preventive measure for the defendants not related to imprisonment. In 100% of cases, the court granted the motion,” the report specifies.

It’s worth adding that, within the framework of the monitoring, 520 court sessions were considered throughout the republic.
