Kyrgyzstan: Prosecutor’s Office stopped the pre-trial proceedings on the torture of a policeman
The Military Prosecutor’s Office of the garrison of Balykchy decided to stop pre-trial proceedings on torture of policeman Aibek Dzhakypov, who worked in the village of Tyup (Issyk-Kul region). This was reported to ACCA by Dzhakypov’s lawyer Zhyldyz Adylkanova.
She explained that the prosecutor made such a decision on the basis of a comprehensive forensic psychological and psychiatric examination conducted in relation to her client.
“This conclusion was not in favor of Dzhakypov, and for some reason the prosecutor considered it a sufficient basis for terminating the pre-trial proceedings. At the same time, the medical examination, which testified that the man suffered minor bodily injuries, was generally charged off. They said that Dzhakypov inflicted these injuries on himself,” said the lawyer.
She noted that she was trying to appeal against the prosecutor’s decision. The complaint was submitted on April 14, 2022.
In 2020, relatives of policeman Aibek Dzhakypov, who worked in Tyup, turned to the Coalition against Torture. They stated that in March of the same year, employees of the Department of the State Committee for National Security for Issyk-Kul region planted drugs on him and illegally detained him.
According to Dzhakypov’s relatives, the case wasn’t brought to court for more than six months, because ‘there is no evidence of guilt’. However, they didn’t stop it. Dzhakypov also stated that he was subjected to torture.
“They beat him. He had a brain concussion. His left eyebrow was cut. The whole face was bruised, not to mention his body. Aibek wrote the statement about this.
Aibek was at a pre-trial detention center for a month. Then, on our appeal, the Regional Court released him under house arrest. Aibek was at home for seven months, didn’t go anywhere. During that time, he was called in for questioning one or two times. On October 9, after all our people exploded from injustice, my son went to Bishkek with the hope of finding protection and getting justice,” Umut Berdybekova, the man’s mother, said at the time.
On October 12, 2021, Aibek was again locked up in a pre-trial detention center, and in December of the same year he was released under house arrest. This preventive measure has been applied to him so far.
