In Kyrgyzstan, the government will pay $4300 for death in the isolation ward
On February 24, the City court of Bishkek upheld the decision of the Pervomaisky District court of December 21, 2019 to recover compensation in the amount of $4300 (300 000 KGS) from the Ministry of Finance for the death of Rakhmanberdi Ernazarov in the detention center of Osh.
“In 2005, Rakhmanberdi Ernazarov died while in custody in the temporary detention center in Osh. 15 years later, compensation will be paid to his family for the caused damage,” said the human rights organization “Justice” in Jalal-Abad.
The plaintiff was the brother of the deceased, Mamatkarim. He appealed to the court with the Ministry of Finance to recover compensation for material and moral damage. The man motivated his claim with unlawful actions of employees of the investigating authorities. In particular, that the fact of the violent death of his brother was not investigated and disclosed.
Recall that Rakhmanberdi Ernazarov was found in a detention center with a throat cut. Six cellmates testified that they found the deceased in the toilet. Allegedly, being there, he himself inflicted fatal injuries. In 2005, the investigating authorities concluded that “during the investigation it was not possible to obtain evidence that his cellmates or police officers had injured him”.
The brother of the deceased appealed to the UN Human Rights Committee. The Committee found the Kyrgyz Republic responsible for arbitrary deprivation of life and torture of Rakhmanberdi Ernazarov.
“An effective remedy was not provided. The remedy must include an impartial, effective and thorough investigation into the circumstances of the death,” the statement of the UN Committee says.
