In Kyrgyzstan, employees of pre-trial detention center №1 refuse to accept persons from temporary detention facilities

The Coalition against Torture reports that the temporary detention center of the Central Internal Affairs Directorate is full. At the time of the visit, there were 59 people, 6 of them were women. The pre-trial detention center №1, without any legal justification, refuses to accept persons from temporary detention facilities.

On May 15, 20 people from the temporary detention center of the city police department of Bishkek were transferred to the pre-trial detention center №1. All detainees had a negative result for coronavirus; the tests were done in advance. Despite this, the pre-trial detention center refused to accept 9 people, explaining that the medical examination of detainees by narrow specialists is necessary.

“Employees of the pre-trial detention center №1 violate the internal rules of pre-trial detention facilities. They may refuse to admit a detainee only if a person needs, according to the conclusion of the medical officer of the detention center, inpatient treatment, in the absence of the possibility of such treatment in the detention center. In other words, there are no legal grounds for refusal due to the fact that examinations of narrow specialists and some MRI examinations are necessary,” the Coalition against Torture considers.

The Coalition emphasizes that the practice of pre-trial detention center’s employees in refusing to accept detainees, with reference to their state of health, was noted earlier too. At the same time, human rights defenders recall that according to the law “On the procedure and conditions of detention”, the pre-trial detention center of the Internal Affairs department is intended exclusively for the persons, who are detained on suspicion of committing a crime.
