In Kyrgyzstan, deliberate police inaction lasts 5 years
Officials of the Police department of Sokuluk region for 5 years deliberately dragging out an investigation of the criminal case. Such a complaint was addressed to the Ombudsman of the Kyrgyz Republic by a Kyrgyz citizen.
“In 2014, unknown people climbed into my house and took out valuable things. At that time, construction was underway at the site, so they stole building materials and broke the fence,” said the victim.
On the fact of the robbery, he addressed to the Department of Internal Affairs of Sokuluk region with a statement, on the basis of which on September 30, 2014 the Prosecutor’s Office initiated a criminal case.
“That’s it. No more movements have been and are not to this day. They are investigating the matter. There are suspects, but they are not even summoned for interrogation,” the man complained to the Ombudsman’s Institute.
At the Ombudsman’s Institute, they said that on the basis of the complaint, the Department’s employees for the observance of human rights and legitimate interests sent a letter to the Prosecutor’s Office of Sokuluk district of Chui oblast for clarification of the case.
“We were informed that the criminal case has indeed been open since 2014. However, over the past time, due to constantly changing investigators at the Sokuluk District Police Department, the case was repeatedly dismissed, explaining its refusal by the lack of corpus delicti. But the Prosecutor’s Office reversed the decision of the investigators and sent the case for further investigation,” the Ombudsman’s Institute informed ACCA.
In violation of a number of legislative norms and acts, police officers of Sokuluk region did not take appropriate measures and actions to comply with the instructions of the Prosecutor’s Office. In this regard, on May 18, 2019, the Sokuluk District Prosecutor’s Office sent an investigative order to the Head of the Internal Affairs Department to ensure the appearance of the defendants in the criminal case to carry out the necessary investigative actions. However, police officers did not ensure the appearance of these persons in the investigation department.
Currently, the District Prosecutor’s Office has made a submission addressed to the chief of the Main Directorate of Internal Affairs of Chui region on taking disciplinary measures against a number of senior officials and investigators of the Sokuluk District Police Department.
“The Investigative Service of the Department of Internal Affairs of Sokuluk region deliberately ignored the multiple orders of the District Prosecutor’s Office and deliberately delayed the investigation of the previously initiated criminal case, that we pay special attention to the leadership of the Ministry of Internal Affairs of the Kyrgyz Republic,” the Ombudsman’s Office emphasized.
