In Kyrgyzstan, $14.3 thousand will be paid to torture victim

The Pervomaisky District court of Bishkek obliged to recover from the Ministry of Finance $14 360 (1 million KGS) in favor of the torture victim. This is reported by the human rights organization “Spravedlivost” [“Justice”].

The court ruled to recover from the state treasury represented by the Ministry of Finance of the Kyrgyz Republic at the expense of the funds provided for financing the Ministry of Internal Affairs in favor of a torture victim [25-year-old resident of the village of Kyzyl-Zhar Anarbek uulu Esenbek] the compensation for moral damage in the amount of $14 360 (1 million KGS). The interests of the torture victim Anarbek uulu Esenbek were defended by the lawyer of the Jalal-Abad human rights organization “Spravedlivost’” [“Justice”], Sardor Abdukhalilov.

In addition, the court partially satisfied the recovery of material damage in the amount of $161 (11 233 KGS) for transportation and medical expenses.

According to the human rights organization “Spravedlivost’” [“Justice”], Anarbek uulu Esenbek was detained on December 11, 2015 by employees of the Tash-Kumyr police department on suspicion of having committed apartment thefts. In an attempt to beat out a confession, the police tortured Esenbek, put on him a plastic bag, a gas mask. Due to severe pain, the detainee said that he agreed to take whatever they say, so that they would not beat him again. However, the security forces did not stop there. They stripped Esenbek, took him to the courtyard of the city department of internal affairs and began to pour cold water over him from the well.

The fact of causing bodily harm to Anarbek uulu Esenbek was proved. On December 25, 2015, on the fact of torture, the Jalal-Abad prosecutor opened a criminal case against the police officers of Tash-Kumyr: the local police inspector Avtandil Bolotov, operational officers and police captains Elzar Ibraimov and Shekerbek Azhibekov. On November 22, 2016, the court of first instance acquitted law enforcement officers under the article “Torture”, but under the article “Excess of official powers” ​​they were found guilty and sentenced to 6 years in prison with a sentence in a maximum security penal colony. On December 21, 2017, the Regional court of Jalal-Abad convicted police officers of both torture and abuse of power and sentenced them to 8 years in prison with a sentence in a penal colony of high security.
