In Kazakhstan, authorities exacerbate punishment for pedophilia

Kazakhstan intends to join the Council of Europe Convention on the protection of children from sexual exploitation and sexual abuse. This statement was made by the General Prosecutor of the republic Gizzat Nurdauletov, responding to the inquiry of the deputies of the Senate of the Parliament concerning what measures are being taken in the republic to protect the rights of children.

The deputies also demanded in their request to exacerbate the punishment for pedophiles and to bring the legislation in the field of child protection rights in line with international standards.

“The Prosecutor General’s Office, together with interested state bodies, is taking a range of measures. In particular, the Ministry of Internal Affairs has begun to develop a bill with a view to toughening penalties for sexual crimes against minors, including detention in institutions of maximum security (a strict regime colony), serving a sentence without the right to pardon and early release,” the Prosecutor General answered.

Gizzat Nurdauletov also said that his department proposes more frequent use of chemical castration of pedophiles.

“The Prosecutor General’s Office proposed to expand the practice of applying medical measures for all sexual crimes aimed at identifying and treating persons prone to sexual violence, unconditionally sending pedophiles to a strict regime colony without the right to mitigate their punishmen,” Nurdauletov said.

Another innovation under discussion is the abolition of jury trial for pedophiles. With regard to bringing legislation in line with international standards, according to the Prosecutor General, the adoption of new measures to protect human rights, including the adoption of legislative measures to protect citizens (especially children) from cyberbullying and accession to the Optional Protocol to the Convention on the rights of the child, a legislative process has already begun.

“The deadline for it is in February 2021. As part of this work, it is planned to discuss the issue of joining the Council of Europe Convention on the protection of the rights of children from sexual exploitation and sexual abuse. Normative work is continued,” concluded Nurdauletov.

It should be noted that according to the Committee on legal statistics and special records of the General Prosecutor’s Office, 197 people were convicted for committing criminal offenses against the sexual inviolability of minors in the first half of this year. The total number of the convicted of these crimes is 1868 people. And the electronic portal “Map of persons who committed sexual assault against minors” contains data on 237 convicted pedophiles.

It should be added that according to the approved draft budget of Kazakhstan for 2021-2023, the total amount of transfers for activities that reduce sexual desire, carried out on the basis of a court decision, will be about $ 88 thousand.
