The court of the North Kazakhstan region sentenced the initiative official Bolat Dzhumabaev, who served as the head of the communal state institution Maintenance Department of the communal state institution Apparatus of the mayor’s office of the North Kazakhstan region, to seven years in prison. His deputy, Yerkesh Sagdeyev, received a term of two times less – three and a half years.
Bolat Dzhumabaev took over the management in January last year. In April, he hired Yerkesh Sagdeev as his deputy. The department was in charge of the maintenance of all buildings and structures belonging to the mayor’s office of the region, and also monitored the order in the local residence of the president, located in the village Teplichnoye near Petropavlovsk.
It was from this facility that Dzhumabaev began his corrupt path. As follows from the materials of the case, at the beginning of the year, $ 2,160 was allocated from the regional budget for cleaning the septic tank located in the presidential residence. In February, Dzhumabaev asked an acquaintance of his, an individual entrepreneur, to conclude a fictitious agreement with the Maintenance Department to carry out these works. The official did not begin to devote the businessman to all the nuances of the transaction, he only explained that the money for this work would have to be returned to him so that he could settle accounts with those who would actually clean the septic tank. The contract was concluded for $ 2120.
Then, taking advantage of his official position, Dzhumabaev ordered to involve the Kyzylzhar Su enterprise in cleaning the septic tank, which provides the population of Petropavlovsk with drinking water and receives wastewater. It should be noted that the 100% founder of Kyzylzhar su is the regional mayor’s office. Apparently, the company was cleaning the septic tank for free. And the money that was allocated for this was cashed out by an individual entrepreneur and given to Dzhumabaev. According to the investigation, for the period February-August 2020, Dzhumabaev thus appropriated more than $ 1000.
The Anti-Corruption Service detained the official in August last year.
During the investigation, other machinations surfaced as well. So, for example, it turned out that he also entered into a fictitious agreement with the same individual entrepreneur to carry out work on the maintenance of the pool in the presidential residence. According to the contract, $ 356 was to be allocated monthly for the maintenance of the pool, and the total amount of the contract was $ 2853. At the same time, Dzhumabaev found a private person on the ad website, with whom he agreed that he would serve the pool for $ 140 per month. The official also appropriated the resulting difference. He managed to enrich himself by maintaining the pool for $ 552.
Dzhumabaev did not miss the opportunity to make money on the pandemic. When the question arose about the purchase of an antiseptic for the mayor’s office, the official involved his acquaintance in this matter. For winning the competition, he demanded a bribe of $ 116.
In June 2020, he received a bribe of $ 1,120 from another entrepreneur for winning a competition to install a fire alarm system in a Maintenance Department building. And another $ 120 from the same person for winning the competition for fire-retardant protection of wood in the building and maintenance of fire-fighting equipment.
As for Sagdeev, with his personal and direct participation, Dzhumabaev was able to pull off another profitable deal. Maintenance Department intended to purchase workwear and footwear. One of the local entrepreneurs agreed to supply the required product for $ 1,500. However, Dzhumabaev and Sagdeev did not like this alignment and they persuaded the entrepreneur to double the cost of the lot. However, later it turned out that this amount exceeded the norms established by law. Then they persuaded the entrepreneur to involve another company in the business – the Petropavlovsk educational and production enterprise of the public association Kazakh Society of the Blind, with the participation of which they could set the required cost of the lot without regard to the law. The head of the local society of the blind agreed to participate in this scam for 15% of the transaction amount. After the overalls and shoes were ready, the entrepreneur paid off with the society of the blind, received his money for the goods, and transferred the difference in the amount of $ 1115 to Sagdeev and Dzhumabaev.
The case materials are full of other episodes that allow Dzhumabaev and Sagdeev to illegally enrich themselves at the expense of the state.
It should be noted that both defendants did not admit their guilt at the trial and asked to dismiss the case against them, as they were forced to abuse their official positions because of the imperfection of the laws of the republic on public procurement.
However, the court did not heed these explanations and found both defendants guilty.
As a result, Dzhumabaev was sentenced to 7 years in prison, and his deputy, Sagdeyev, was sentenced to 3.6 years of imprisonment in a general regime colony with life imprisonment to hold positions in the civil service.
