Kyrgyzstan: the beating of a witness by police was attempted to cover up

The case of the beating of the witnesses in the case of bribery by the employees of the Pervomaisky District Department of Internal Affairs was tried to cover up. The situation changed after the intervention of the Ombudsman.

The human rights defenders were approached by the applicant, who reported about the insult and beating by the officers of the Pervomayskiy District Department of Internal Affairs of Bishkek. On this fact, the Prosecutor’s Office of the Pervomaisky District, together with the Internal Investigation Service of the Ministry of Internal Affairs, conducted an inspection.

All collected materials were sent to the prosecutor’s office of the Oktyabrsky district of the capital for making a decision under the requirements of the norms of the criminal procedure code of the Kyrgyz Republic. However, the prosecutor’s office, without questioning the applicant and the police officers, and allegedly finding no confirmation of these facts, decided to write off the materials into the indexed registered record.

In this regard, a letter was sent to the Bishkek prosecutor from the Ombudsman’s office with a request to cancel the results of the rejected material and to re-check. Only after the above measures were done “the situation got off the ground.”

“The materials of the citizen’s case were requested and studied by the prosecutor’s office of Bishkek, the previous results of the refusal proceedings were canceled and the case was sent for a new consideration to the prosecutor of the Oktyabrsky district. The statement was registered on the grounds of a crime under Article 321 “Excessive power” of the Criminal Code of the Kyrgyz Republic, “the Ombudsman’s office reported.

In addition, it became known that one of the operatives of the Department of Internal Affairs of the Pervomaisky District of Bishkek, whom the applicant complained about, had previously been detained by officers of the State Committee for National Security of the Kyrgyz Republic on suspicion of extortion using his official position in the amount of $ 500. He is currently being held in a pre-trial detention center of the State Committee for National Security.
