Kyrgyzstan: the judge declared illegal the termination of the criminal case on the fact of Askarov’s death

The Sverdlovsk District Court of Bishkek upheld the complaint of the lawyer Aydar Sydykov against the decision of the investigator of the State Service for the Execution of Punishments to terminate the criminal case on the death of human rights defender Azimzhan Askarov, thus recognizing the decision of the investigator as illegal and unfounded. This was reported by the human rights organization “One World (Bir Duino)”.

The investigating judge considered the arguments of the investigator about the impossibility of interrogating witnesses due to their failure to appear or absence as untenable, since procedural legislation and international treaties provide for mechanisms for the implementation of certain actions to carry out investigative orders and measures to ensure criminal proceedings.

It’s worth noting that the State Service for the Execution of Punishments was engaged in the investigation of the death. The Department came to the conclusion that there were no violations, Askarov died due to pneumonia, that is, death was natural.

Human rights activists are convinced that the timely provision of high-quality medical care could improve his condition, especially since they and Askarov himself have repeatedly asked for this. However, all appeals were rejected, as a result, on July 25 last year, human rights activist Azimzhan Askarov died in the correctional colony No. 47.

The court ruling of August 23 came into force, but the other party has 5 days to appeal it. Lawyer Sydykov intends to secure the transfer of the investigation on the fact of the death of the human rights defender to the State Committee for National Security. His work is aimed at bringing the persons involved in this case to justice.
