Investigation into death of Azimzhan Askarov will be resumed in Kyrgyzstan

On July 27, the City Court of Bishkek considered a complaint in defense of the interests of Haditha Askarova concerning the recognition of illegal the decision to terminate pre-trial proceedings on the death of human rights activist Azimzhan Askarov. This was reported by One World (Bir Duino).

The interests of the victim were represented in court by the lawyer of the human rights movement “One World (Bir Duino)” Aydar Sydykov.

On July 1 of this year, a complaint by lawyer Sydykov to the Sverdlovskiy District Court of Bishkek against the decision of an investigator of the State Penitentiary Service to terminate pre-trial proceedings on the death of Azimzhan Askarov was terminated by the court due to missing the deadline for its appeal. In this connection, the appeal was filed with the City Court of Bishkek.

According to Askarov’s defenders, the judge of first instance violated the norms of the criminal procedure legislation and the court incorrectly applied the norms of criminal law.

On July 27, the City Court of Bishkek, supporting the arguments of the lawyers, decided to cancel the earlier decision of the investigating judge of Sverdlovsk district to terminate the proceedings on the complaint of the lawyer. The decision was made on the basis of the order of investigator of the State Penitentiary Service to terminate the criminal case on the death of human rights defender Azimzhan Askarov.

Thus, the case will be returned for review to the Sverdlovskiy District Court. The lawyer also intends to file a complaint with the Disciplinary Commission of Judges against the actions of the investigating judge of the Sverdlovsk District Court, Mr. Tumonov.

It’s worth recalling that in July 2020, human rights activist Azimzhan Askarov died at the age of 69 in the medical facility of the colony No. 47. Shortly before the death of the human rights defender, his lawyers insisted on immediate hospitalization of their client due to the worsening of his state of health. However, the State Penitentiary Service refused them, recognizing Askarov’s state of health as satisfactory.
