Kyrgyzstan: detainees are not properly examined in isolation wards

The territorial office of the National Center for the Prevention of Torture of Kyrgyzstan announced the results of special preventive visits to closed institutions in Osh city and Osh region.

In June this year, employees of the territorial office of the National Center of the Kyrgyz Republic for the Prevention of Torture visited the pre-trial detention center of the Department of Internal Affairs of Osh and Osh region to check how the instructions for conducting a medical examination of detainees upon delivery to the temporary detention center are being followed.

It should be noted that this form of medical examination was approved by the Minister of Public Health of the Kyrgyz Republic in March 2020. In May 2021, employees of the National Center for Internal Affairs of the Kyrgyz Republic in the city of Osh and Osh region reminded in the letter to the administration of the Regional Department of Internal Affairs about the need to use it when placing a detainee in a temporary detention facility.

“However, during special preventive visits to the temporary detention facility of the Department of Internal Affairs of Osh, the Internal Affairs Directorate of Karasu, Aravan and Nookot districts, it became known: despite the fact that the Department of Internal Affairs of Osh region sent the letter for implementation, this form of medical examination is not applied. Employees continue to fill out an alcohol and drug intoxication test form, which usually states that there are no injuries on the body and no health complaints have been received. In addition, an ordinary paper certificate is drawn up stating that no injuries were found on the human body,” said Khudayarzhan Narmatov, the head of the territorial office of the Center for the Prevention of Torture in Osh city and Osh region.

The temporary detention center of the Department of Internal Affairs of Alay district of Osh region is ready to fill out a medical examination form, but didn’t use it, since there were no new detainees there for a month. Nevertheless, shortcomings were also revealed in the work of a closed institution; there are not enough dishes (bowls and spoons). The administration was recommended to eliminate violations, which were noted in the register for inspectors.

“In the temporary detention facility of the Department of Internal Affairs of Uzgen and Kara-Kulja districts, the form of a medical examination wasn’t used, since there were no detainees recently either. But in the temporary detention center of the Department of Internal Affairs of Kara-Kulja district, detainees complained about food, lack of bowls, spoons and mugs. The head of the temporary detention center was given recommendations to eliminate these shortcomings, and the results were also noted in the register for inspectors,” was said by the Regional office of the National Center for the city of Osh and Osh region.

In addition, a letter was sent to the head of institution No. 25 of the State Penitentiary Service (the pre-trial detention center No. 5). It recommends that the medical unit of the institution, when accepting those transported from temporary detention facilities of the Internal Affairs Directorate of Osh city, Osh region, Jalal-Abad and Batken regions, require their chiefs to fill out a new form of medical examination when placing a person in the isolator and not accept detainees according to the old samples.

Based on the results of special preventive visits to closed institutions, the employees of the territorial office of the Center for the Prevention of Torture drew up acts on violations of the conditions of detention and sent them to the Prosecutor’s office of Osh region for taking appropriate measures.
