Kazakhstan: bribe-taking judge stands trial

A trial in the case of Yerzhan Gabdullin, a former judge of the Specialized Inter-district Economic Court, has begun in the Kazybi District Court of the city of Karaganda.

Yerzhan Gabdullin was detained on February 5 this year. As it became known then to ACCA, the judge received a large sum of money for assisting in solving a court case in favor of the construction company “Olivia”, which is engaged in the construction of housing within the framework of various state programs. It’s worth noting that the arrest of the judge was carried out by the staff of the Anti-Corruption Agency.

The 52-year-old ex-judge ended up in the dock not alone, but with Elena Kanter-Skripkina, the lawyer of the construction company “Olivia”.

As established by the investigation, Kanter-Skripkina worked as a bailiff at one time. Then she held the post of assistant to the mayor of the city of Shakhtinsk, and in recent years she was engaged in private practice, combining this activity with work in the construction company. Kanter-Skripkina has been on friendly terms with Yerzhan Gabdullin for over 20 years.

According to the investigation, in September last year, the construction company “Olivia” took part in tenders for the construction of two multi-storey buildings in Oktyabrsky district of the city of Karaganda. However, the company lost the competition, and another company became the winner. The administration of Olivia didn’t agree with the loss and instructed the lawyer Elena Kanter-Skripkina to appeal the decision of the competition commission in court in order to recognize Olivia as the winner of the tender.

Taking advantage of friendly relations, Elena Kanter-Skripkina turned to the judge of the Specialized Inter-district Economic Court Yerzhan Gabdullin with a request to assist in satisfying Olivia’s claims. Gabdullin promised to help, but asked for about $ 18.8 thousand in order to grease palm of his colleagues, who are considering the claim of Olivia, and colleagues from the appellate instance.

At the same time, he asked to transfer the money after his colleagues consider the claim. Judge of the Specialized Inter-district Economic Court Erbol Maypasov, having examined the claims of the construction company, considered them reasonable and recognized Olivia as the winner of the tender.

After that, Elena Kanter-Skripkina began to collect money for Gabdullin. Having collected 10,000 euros and 7,000 dollars in local currency, she contacted Gabdullin via the Signal messenger to discuss the details of the transfer of money. It’s noteworthy that the defendants called the money “medical tests” in their correspondence.

“Judge Yerzhan Gabdullin, occupying a responsible state position, persuaded Elena Kanter-Skripkina to give a bribe and committed fraud. He misled Elena Kanter-Skripkina and deceived her money. On February 5, 2021, the judge Gabdullin sent an intermediary to Elena Kanter-Skripkina, who took the money from her and handed it over to his wife in the presence of the judge. Subsequently, during a search, this money was seized in the judge’s house,” state prosecutors said at the trial.

It’s worth noting that the judge is not charged with taking a large bribe, but only incitement to bribe, since he allegedly took money not for himself, but for his colleagues. The second article, charged to the judge, was fraud.

Elena Kanter-Skripkina is charged with attempted bribe-giving in a significant amount. It’s worth noting that the lawyer of the construction company admitted the charges against her and repented of what she had done, but the judge didn’t agree with the accusations and their qualifications.
