Kyrgyzstan: authorities rehabilitate supporters of Bakiyev’s clan

With the coming to power of Sadyr Japarov, the Supreme Court has overturned several sentences against officials who were considered close to the clan of Bakiyev, against the relatives of the second President of the Kyrgyz Republic, who fled to Belarus after the revolution in April 2010. In addition, the verdict against the sister of Japarov, convicted earlier for the raider seizure of the bank, committed with the assistance of Maxim Bakiyev (the son of the fugitive president), was reversed.

On February 4, 2021, it became known that the Supreme Court of the Kyrgyz Republic recalled the decisions of the previous instances in relation to Raikul Japarova, the sister of the President Sadyr Zhaparov. Earlier, she was convicted in absentia for the raider seizure of OJSC Investment Bank Issyk-Kul in 2007 with the assistance of Maxim Bakiyev (the son of the former President of the Kyrgyz Republic Kurmanbek Bakiyev). She was found guilty of committing crimes under the articles “Complicity in a crime, in the legalization (laundering) of criminal proceeds”, “Fraud” and “Abuse of powers by employees of commercial and other organizations” of the Criminal Code of the Kyrgyz Republic. She was sentenced to 10 years in prison with confiscation of property.

At the press conference on February 4, the Prosecutor General of the Kyrgyz Republic Kurmankul Zulushev said that Raikul Japarova could return to Kyrgyzstan without hindrance, since the Supreme Court canceled the court decisions against her on January 25, 2021.

“The measure of restraint has been changed for her. Earlier she was put on the wanted list, but now she can freely return to Kyrgyzstan,” he said.

The main supervisory department told reporters that the case of Raikul Japarova was sent for investigation to the State Service for Combating Economic Crimes (Financial Police).

Opposition politicians sharply criticized the fact that the Supreme Court overturned the sentences imposed on Raikul Japarova six years ago exactly when her brother Sadyr Japarov became President.

Less than a week later, it turned out that the Supreme Court also overturned the sentences against the ex-mayor of Bishkek, Nariman Tyuleev, who had called Bakiyev’s “father”.

Tyuleev himself announced this on his Facebook page. According to him, since 2012 he fought for justice, went through all the trials, was behind bars, suffered a lot of hardships and destitutions.

Tyuleev noted that he repaid the damage by the decision of the Supreme Court only so that completely innocent guys would not languish behind bars away from their families. And he never admitted his guilt.

“After serving my sentence, I didn’t stop fighting. We filed lawsuits, proved our innocence; and finally the historic day has come. For several months, the Supreme Court of the Kyrgyz Republic, having studied all the circumstances of the case, ruled to annul the conviction of all three instances (Leninskiy Court, City Court and Supreme Court) and sent it for new consideration to the Leninskiy Court,” he wrote.

More recently, it became known that on April 27, 2021, the Supreme Court overturned the verdicts of the City Court of Jalal-Abad (dated March 25, 2020) and the Regional Court of Jalal-Abad (dated December 10, 2020) against Kanibek Bakiyev, the brother of former President Kurmanbek Bakiyev.

The press service of the Supreme Court explained that the criminal case was sent for new consideration to the City Court of Jalal-Abad “due to incomplete investigation of the materials of the criminal case, procedural violations, and also due to the discrepancy between the conclusions of the courts and the actual circumstances”.

According to information from open sources, Kanibek Bakiyev was accused of abuse of office. The City Court of Jalal-Abad sentenced him to 6 years in prison on March 25, 2020. On December 10, 2020, the Regional Court of Jalal-Abad changed the decision of the previous instance, fining Bakiyev 4 million KGS.

In 2005, Kanibek Bakiyev was the head of the village of Yrys in Suzak district. Later, the documents on the distribution of land plots were declared illegal.

After the events of April 2010, he was also accused of forming illegal armed groups.

It’s worth recalling that the current President of Kyrgyzstan Sadyr Zhaparov was previously convicted under several articles of the Criminal Code of the Kyrgyz Republic, including for taking hostages, and was serving his sentence in the colony. He literally got into the chair of the head of state straight from the prison.

Soon after the events in Bishkek in October 2020, the courts hastily reviewed criminal cases against the then Prime Minister and Acting President Sadyr Zhaparov, Chairman of the State Committee for National Security Kamchibek Tashiev, MP Talant Mamytov, who later became the speaker.

All three were tried in 2012 for attempting a violent seizure of power. The convictions of Mamytov and Tashiev were considered canceled. Although some lawyers, including the ex-judge of the Constitutional Chamber of the Kyrgyz Republic, Klara Sooronkulova, believe that convictions under especially grave articles of the Criminal Code, which include an attempt to forcible seizure of power, can be extinguished no less than ten years later.
