Kyrgyzstan: suspects are illegally kept in detention facilities in Bishkek

In violation of the law, 24 people are kept in the temporary detention center of the Main Department of Internal Affairs for more than ten days, despite the existing court order. This was reported by the Ombudsman’s Office of the Kyrgyz Republic.

The monitoring group of the Ombudsman’s Office of the Kyrgyz Republic conducted a planned preventive visit to the temporary detention center of the Main Department of Internal Affairs of Bishkek.

“At the time of the inspection, there were 70 people in the temporary detention center, of which 8 were women. The study revealed facts of prolonged detention of 24 suspects more than 10 days from the date of the decision. So, in the decision of the investigating judges, the detention facility No. 1 under the State Penitentiary Service was chosen as the place of detention for these suspects,” the Office said.

Human rights activists emphasize that this violation is systematic and has been persisting for a long time. The Ombudsman’s Office of the Kyrgyz Republic has repeatedly appealed to the Prosecutor’s Office with a request to pay special attention to this problem.

As a result of the conversation with the administration of the detention center, it was also revealed that the detainees were not duly granted the right of suspects to independently appeal against the decision of the investigating judge to choose a preventive measure in the form of detention.

“Thus, in accordance with paragraph 7 of article 116, “the administration of the place of detention, in cases of receiving a complaint against a court order, is obliged to send the complaint to the appropriate court no later than 12 hours from the moment of receipt”. According to the information provided by the administration of the detention center, there is no special register for complaints and statements from detainees in the isolation ward. During the year, only one suspect exercised this right,” the Office says.
