Kyrgyzstan: court condemned previously acquitted rapists of 13-year-old girl

The Prosecutor’s Office of Ton district of Issyk-Kul region appealed the decision of the district judge and achieved toughening of punishment for the rapists of a 13-year-old girl. This was reported by the Prosecutor General’s Office.

On March 29, 2021, the Regional Court of Issyk-Kul granted the request of the prosecutor of Ton district of Issyk-Kul region and found two accused guilty under the article 161 “Rape” of the Criminal Code of the Kyrgyz Republic. They were sentenced to imprisonment for 15 years. The court changed the sentence for the third accused from 7 years 6 months to 20 years in prison

“Regarding the judge of Ton district, who acquitted two accused, the Regional Prosecutor’s Office of Issyk-Kul sent a submission on December 30, 2020 to the Disciplinary Commission under the Council of Judges of the Kyrgyz Republic to prosecute him. It’s currently under consideration,” the Prosecutor General’s Office explained.

In connection with the rape of a 13-year-old girl in the village of Kara-Shaar (Ton district, Issyk-Kul region), three villagers were detained, two of whom are 28 years old, the third one is 41 years old.

Based on the results of investigation, the criminal case was sent to the District Court of Ton for consideration on the merits. The state prosecutor asked to punish two accused in the form of imprisonment for a period of 15 years each, and in relation to the third one – in the form of imprisonment for a period of 20 years. Following the results of the trial, in December 2020, the District Court of Ton acquitted two of the accused and released them from custody from the courtroom. And in relation to the third defendant, he was sentenced to 7 years and 6 months in prison.
