Kyrgyzstan: defendants, who are accused of torture, deliberately delay the trial

For the third time, due to the failure of the defendants’ lawyer to appear, the court hearings in the case of torture of 26-year-old resident Muhammad Kanibek uulu by law enforcement officers have been postponed. The young man died as a result of torture. The information about the postponed hearing was reported by the human rights organization “One World (Bir Duino)”.

On March 25, a judge of the City Court of Osh made a decision once again to postpone the trial due to the absence of a lawyer defending the interests of six former employees of the Regional Department of Internal Affairs of Osh. They are accused of torturing Muhammad Kanibek uulu as a result of which the latter died.

“Once again, the process was postponed due to the lack of the defendants’ lawyer. They submitted a certificate stating that the defense lawyer was being treated in a hospital. This was the third hearing he was absent from. The lawyer, who represents the interests of the injured party, made a recommendation on the application of the procedure for the provision of lawyers in accordance with state guaranteed legal assistance. However, the defendants opposed the replacement of their defense lawyer. As a result, the judge made a decision to postpone the hearings until early April,” the human rights activists shared their impressions.

On October 15, 2020, after the arrest, a 26-year-old resident of Nookat region, Muhammad Kanibek uulu, died. Numerous traces of beatings, abrasions and bruises were found on his body. As later the examination established, the cause of death was a strong attack to the chest area.

On November 19, six employees of the Internal Affairs Directorate of Osh region, aged 31-39, were detained. In March, the case was transferred to the City Court. They are charged under five articles: torture, causing death by negligence, abuse of power, abuse of office, illegal imprisonment.
