The UN Committee recognized Ulan Nazaraliev as a victim of torture and decided to exact compensation from the state in his favor. This is reported in the human rights organization “Justice” in Jalal-Abad.
Based on this decision, Nazaraliev’s lawyer Sardor Abdukhalilov appealed to Pervomaisky District Court of Bishkek with a demand to recover $ 35,000 (3 million KGS) from the Ministry of Finance.
The materials of the statement of claim said that 38-year-old Ulan Nazaraliev in the temporary detention center of the Police department of Jalal-Abad was “beaten, kicked and strangled”. And when he complained of a headache, the police officers gave him a razor blade saying that “he can even cut himself, and no one will help him”. In hopeless situation, the man cut his wrists.
“They called the doctors. Ulan was taken to the Regional hospital of Jalal-Abad to put in the stitches and to dress the wound. The next day, they began to bang Nazaraliev’s head against the wall in their office. Unable to endure the physical pain, he removed the stitches from the wound on his hand. The wound began to bleed; Ulan fell to the floor. The officers of the temporary detention center started kicking him in the chest and left kidney. Then they handcuffed his right wrist to a heating battery. The man was left in this position for an indefinite period of time,” said the lawyers of the human rights organization “Justice”.
Ulan Nazaraliev was admitted to the neurological department of the Regional hospital and held in a special guarded ward for administrative and investigative persons. On admission, he was diagnosed with closed craniocerebral trauma and hypertension. Because of bruises in the kidney area, the man experienced severe pain and could not urinate.
In addition, as follows from the materials of the case, psychological pressure was exerted on Ulan. Thus, during the transfer from one institution to another, the police officers mocked and humiliated him. They took off the man’s underwear and photographed his genitals.
Unable to endure the bullying, Ulan Nazaraliev went on a hunger strike, demanding a meeting with the prosecutor. Four days later, a check was appointed. However, the investigator, who examined the case, didn’t find corpus delicti in the actions of the law enforcement officers.
The representatives of the human rights organization “Justice” went to the court. In the first two instances, the complaint about the use of torture against Nazaraliev was upheld. However, the Supreme Court ruled in favor of the Prosecutor’s office of Jalal-Abad and refused to open a criminal case. Having exhausted all legal defense means at the national level, Ulan Nazaraliev addressed his complaint to the UN Human Rights Committee. The Committee took the side of the torture victim. He decided to exact compensation from the state in his favor.
