Kyrgyzstan: special commission found guilty of loss of criminal case

To search for the lost criminal case, the Oktyabrsky District court of Bishkek created a special commission. The Ombudsman’s office informs about it.

Let us remind you that some time ago, a man addressed the Ombudsman of Kyrgyzstan and stated that the Oktyabrsky District court had lost the materials of the criminal case initiated against him in 2004. This is evidenced by the correspondence of the man with the responsible persons of the court.

The man asked the Ombudsman’s office to assist in restoring his violated rights.

“The Ombudsman sent an appeal to the Chief Justice of the Supreme Court with a request to conduct an official investigation in order to establish the location of the criminal case; also, if there is a disciplinary offense in the actions of the responsible persons, bring them to disciplinary responsibility,” the Apparatus clarified.

It is specified that at the request of the Ombudsman, a special commission was created. After the investigation, it came to the conclusion that the unjustified actions of the former head of the Oktyabrsky District court of Bishkek led to the loss of the case.

“We should also take into account the important role in the actions of the City court of Balykchy, which also caused the loss of the above criminal case. In particular, the register of sending the case does not contain the name of the recipient of the mail with the indicated criminal case,” the commission’s conclusion notes.

Thus, the loss of the criminal case is confirmed by the conclusion of the commission of the City court of Bishkek. Due to the fact that the criminal case was never found, the commission plans to send the collected materials to the relevant law enforcement agencies for a legal assessment.

“The Prosecutor’s office and the judicial organs should, as a priority, take all measures to restore the materials of this criminal case,” said Tokon Mamytov. “This will allow the man to be justified on the basis of newly discovered circumstances.”
