Kyrgyzstan: court lost a case of a convict for a life sentence

As part of the investigation into the appeal of a man sentenced to life imprisonment, it turned out that the court had lost the materials of the criminal case. This was reported by the Office of the Ombudsman.

A man, sentenced to life imprisonment, approached the Ombudsman of the republic with a request to assist in the review of his case due to newly discovered circumstances.

According to the applicant, he was sentenced to life imprisonment based on false testimony.

“Since the investigation needed to solve the crime, it went to falsification and fabricated a criminal case,” the man says.

After thoroughly studying the materials of the statement, the Ombudsman sent an appeal to the General Prosecutor’s Office. The response received from the Chui district prosecutor’s office signed by the prosecutor Azamat Chynbayev says that “to verify the arguments indicated in the appeal, it is necessary to study all the materials of the criminal case. In particular, the testimony of the accused and witnesses given during the investigation and in court, the conclusions of the examinations, and the entire evidence base of the prosecution.”

However, the Alamudun District Court did not submit the criminal case to the prosecutor’s office for study due to the lack of it in the archive. In this connection, it is not possible to consider the application of the convicted person. Currently, the search for a criminal case continues.

We add that this is the second case when a criminal case is lost through the fault of officials.
