Turkmenistan: those who refuse to treat serious diseases are facing a prison sentence

On September 7, 2020, article 119 (note 1) of the Criminal Code on malicious evasion from treatment recognized as a dangerous infectious disease of an epidemic or pandemic nature and deliberate infection with it came into force on the territory of Turkmenistan.

Supplement to Article 119 on deliberate infection with AIDS, which says that avoiding treatment of dangerous infectious diseases of an epidemic and pandemic nature will be punished with imprisonment for up to 2 years, if this crime is repeated – up to 5 years in prison. Persons assisting in the commission of this crime will be punished with imprisonment for up to 3 years and deprivation of the right to hold certain positions. The law was signed by the President of Turkmenistan Berdymukhamedov on August 22, 2020.

The adoption of such tough measures was the epidemiological situation in the country, the prohibitive level of corruption, inhuman conditions of detention in quarantine zones, and the powerlessness of the head of state against the spread of COVID-19 in the country.

A massive outbreak of COVID-19 continues in Turkmenistan. We cited data on mortality in the Balkan velayat, where, according to our source, over 1300 people died, and the escapes of patients were recorded due to unbearable conditions. The country has introduced fines for the absence of masks, intercity transportation is stopped, railway communication between regions is stopped, and quarantine restrictions are introduced in all cities without exception. Despite such a deplorable situation, the country’s authorities continue to deny the presence of COVID-19.
