Lawyers of the Jalal-Abad human rights organization Spravedlivost are outraged by the actions of the Ministry of Finance of the Kyrgyz Republic, which does not pay compensation to victims of torture.
“There are court decisions to recover compensation in specific cases. For example, in the case of Chyngyz Suyunbaev, whose brother died as a result of torture, the state has to pay $ 2.5 thousand (200 thousand soms). In the case of Anarbek uluu Esenbek – more than $ 12.8 thousand (million soms). The crime against Akmatov Turdubek (brother of Chyngyz Suyumbayev) was committed in 2005, and in the case of Anarbek uulu Esenbek, a court convicted three police officers of torture in December 2017. Despite the decisions of the courts, which came into force long ago, the Ministry of Finance refuses to pay them, ”said Sardor Abdukhalilov, a lawyer and attorney for the Jalal-Abad human rights organization Spravedlivost.
According to the human rights activist, due to the unfair attitude of the employees of the Ministry of Finance to their duties, victims of torture or their closest relatives cannot receive compensation for the physical and moral harm caused.
“To this day, it is not clear what caused such a delay – bureaucratic delays on the part of the Ministry of Finance or the principled position of the state not to pay victims whose rights have been violated. Thus, the state represented by the Ministry of Finance restricts access to justice and violates the constitutional rights of the above-named persons, ”wonders Abdukhalilov.
Human rights activists call torture cases tiresome.
“There is obstruction at all levels. Firstly, it is very difficult to achieve an initiation of criminal proceedings and investigation into torture. Then, difficulties arise in bringing to criminal responsibility – the vast majority of people who use torture evade responsibility. And when it is possible to make any progress in the matter, it turns out that the Ministry of Finance makes its contribution to the infringement of the rights of citizens. People usually think about this terrible phenomenon only when it concerns themselves, “- said in Spravedlivost.
Human rights activists remind that the Constitution of the country establishes that guarantees for compensation by the state for damage caused by illegal actions of state authorities, local self-government bodies and their officials in the line of duty are not subject to any limitation.
