Lawyers of the Jalal-Abad human rights organization Spravedlivost intend to appeal in court against the inaction of the investigator of the Department of the State Committee for National Security in the Jalal-Abad region.
Human rights activists are unhappy with the fact that for more than a year the torture case against 27-year-old Abzhal Nurubekov, a resident of the village of Torken, Toktogul District, has not been investigated and brought to court.
“The case contains all the necessary evidence. Forensic medical, psychological, and psychiatric examinations have been carried out. Analysis showed that Abzhal was a subject of tortures, ” emphasizes the human rights organization Spravedlivost.
Although Nurubekov was recognized as a victim, the police officers who tortured him have not yet been given a notice of suspicion.
“If he was handed over, the investigator would have to complete the investigation within two months and send the case to court. But without this, the investigator has unlimited time to delay this case. All this suggests that the investigating bodies have incorrect stereotypical thinking since a person complains of torture, it means he wants to avoid punishment, ”said Utkir Jabbarov, chairman of the coordinating council of the Center for the Prevention of Torture of the Kyrgyz Republic.
According to the human rights activist, there is another stereotypical thinking – the investigating authorities are waiting for the end of the process in the main case (in this particular case – illegal possession of drugs for selling). That in case of a positive outcome for himself, the victim of torture can withdraw his statement.
Lawyers of the human rights organization Spravedlivost four times appealed the inaction of the investigator of the UGKNB in the prosecutor’s office, but to no avail.
“We wrote complaints to the Prosecutor General’s Office, the State Committee for National Security, the Security Council and the president. All appeals were sent down to the prosecutor’s office of the Jalal-Abad region. The regional prosecutor’s office replied that pre-trial proceedings are underway. But since none of the representatives of the torture victim, including Abzhal Nurubekov himself, are invited to participate in the investigative measures, we conclude that the investigation is practically not being conducted. The relatives of the victim are also sure of this, ”the human rights activists emphasize.
We will remind, on the night of April 2 to 3, 2019, according to Abzhal himself, the operational police planted drugs to him. Then he was bullied by five operational officers of the Department of Internal Affairs of the Jalal-Abad region to obtain confessions.
“They beat me with their hands and feet. When he said that he would tell about the torture in court, they put a plastic bag over his head. They even beat me with rebar, so much so that the guy wet himself, ”said the victim’s lawyer.
We add that from April 2019 to the present day, Abzhal Nurubekov has been in the temporary detention facility of the Toktogul region.
