Kazakhstan: an official, who was convicted of corruption in February 2020, went at large

The Anti-Corruption Agency exposed the deputy mayor of Kurmangazinsky district of Atyrau region in illegal participation in entrepreneurial activity, as well as in receiving a bribe. Details of the case are not disclosed, as an investigation is still ongoing.

Meanwhile, in the same Atyrau region, the former deputy mayor of the region, Nursaule Sailauova, who was sentenced on February 6, 2020 to two years of imprisonment at the settlement, was released.

This was announced on Facebook on May 11 by her lawyer Anara Kusainova, who was representing Sailauova’s interests.

“The Regional court of Atyrau has decided to release my ward from custody. The protest of the Regional Prosecutor’s office was rejected … She was not acquitted, although there are reasons for this. I hope that the Supreme Court will subsequently correct this legal disgrace, my client will meet today with her family and young son … As a result, a whole year of work made itself felt!” said Kusainova.

Sailauova was detained in March last year. As the Anti-Corruption Agency reported then, the vice mayor was suspected of receiving a bribe through the head of the department of education in the amount of $ 14.5 thousand. It was the so-called “kickback” – 15% of the total transaction amount of $ 97.5 thousand concluded with a private company for the supply of dining room furniture for five boarding schools. In addition, anti-corruption officers suspected the deputy mayor that she, together with the heads of the Educational department and the Methodological Center of the Educational department of Atyrau region, carried out the theft of $ 28.5 thousand allocated for the development of education and science in the region for 2016-2019. According to the Anti-Corruption Agency, the suspects cashed money through affiliated firms.

By the way, other suspects in the framework of these criminal cases were also convicted. So, the head of the Educational department, Kaiyrgali Kenzhegaliev, was sentenced to 2 years of restriction of freedom, his deputy, Roza Kabdolova, received 4 years of imprisonment in a penal colony, director of the Methodological Center, Gabit Kabekenov, and private entrepreneur Nazymgul Mazhitova were sentenced to 3 years of imprisonment, the accountant of the medical boarding house “Geologist of Kazakhstan”, Kansulu Jamelova, the specialist Beibit Zabenov and the accountant of the Methodological Center, Kundyz Imangazieva, received 4 years and 6 months of freedom restriction.

It should be added that the rather mild sentence of Sailauova caused a great resonance in Kazakh society. It was so great, that the Regional court of Atyrau was forced to clarify the sentence. In particular, it was explained that the total damage caused to the state by the actions of officials amounted to about $ 315 thousand. At the same time, convicts voluntarily returned $ 167 thousand. Toyota Land Cruiser Prado ($ 31.5 thousand), the bus ($7 thousand) and a bank account (in the amount of $ 11.5 thousand) also went to pay damages. Thus, the defendants have to reimburse another $145 thousand to the recovery services.

As for the deputy mayor, according to the court, she fully compensated the damage for a total of $ 20.2 thousand.

“Punishment is not judgement; it should help a person to improve. Convicts may exercise the right to parole upon the expiration of the third part of the term or half, depending on the article of the Criminal Code under which they were sentenced. They will never again be able to hold positions in the public service,” the court explained then.

According to the court’s verdict, the time, spent by Sailauova, took into account the time spent in the pre-trial detention center from March 18, 2019 (on the principle of one day as two), it turned out that the defendant was able to be released four months after the trial.

Meanwhile, on May 5 in Almaty, the former mayor of Ala-Tau region, Shahmerden Ryspaev, and his deputy, Sayat Agibaev, were sentenced, as well as the representative of the company “Vek” [“Century”], E. Umiraliev. They were suspected of the budgetary funds’ embezzlement of more than $ 11 thousand allocated within the framework of the state program “Development of regions until 2020” for the organization of festive events on the Independence Day of Kazakhstan and the New Year.

According to the court verdict, the former mayor must pay a fine of $ 118 thousand. His deputy was sentenced to 2 years in prison. The representative of a private company received 3.5 years of restriction of freedom.
