Scandalous information that prisoners in Karaganda are doing repairs in the apartment of one of the new buildings on the orders of the head of the pre-trial detention center first appeared in the public “Patriot of Karaganda”.
As follows from the message, the three convicts were daily taken to the city in police car “Skoda”, which was driven by a senior sergeant. Besides, the prisoners were not under police escort.
“According to the court’s verdict, they should be in cells, but the head of the investigatory isolation ward №16 [CИ-16] ordered them to be taken to a new residential complex, where they had to make repairs. Why don’t the MIA’s senior officials hire professional workers? They have enough money for that. However, apparently, they are too greedy, so they brazenly force prisoners to work in their personal estates. How often people in uniform exploited the convicts and used their free labor is unknown. Surely, many times, and therefore, someone was tired of seeing this mess at the investigatory isolation ward №16 [CИ-16] and reported to its own security department,” the report said.
As soon as the information reached the employees of the department of their own security, the police went to the indicated address of the apartment. There, they really found three prisoners who were doing repairs. According to the convicts, the chief of the pre-trial detention center AK-159/1 [CИ-16], Zhanat Kapeev, directly prescribed them a labor therapy outside the detention center.
A pre-trial investigation is being conducted on this fact.
It’s not the first time that the institution AK-159/1 has been involved in scandal. So, in 2017, the officer of the same pre-trial detention center, Vladimir Andrushkevich, was sentenced to 2 years and 8 months in prison for organizing visits for two prisoners. As a result of these visits, the woman became pregnant. This story became known when the woman had to have an abortion. By the way, it was then established that she had AIDS. Moreover, the woman got the infection when she was free. Andrushkevich was charged with crimes under three articles of the Criminal Code: “Excess of power or official authority”, “Forcing to give false testimonies” and “Knowingly putting another person at risk of HIV / AIDS”. However, the judge of Kazybekbi District court of Karaganda, Aliya Zhosheva, acquitted Andrushkevich. He was acquitted of the last article, since he didn’t know about the diagnosis of the woman, because these data are a medical secret and are not subject to disclosure.
Andrushkevich went to jail alone. Other employees of the pre-trial detention center were not held accountable.
Meanwhile, in June 2017, an open appeal from Andrushkevich’s sister, Anita Kalmychenko, appeared on the official resource of the Prosecutor General’s office, in which she drew the attention of supervisory authorities to the fact that her brother couldn’t organize a bawdy house in the detention center alone.
“I ask you to objectively investigate the case of my brother. The higher officials of the institution AK 159/1 were guilty of what he was convicted. They are Kusainov U.G., deputy chief for operational work, and Salfetnikov K.V., head of the operational department, who, trying to hide the fact of pregnancy of convicted Zenina O.V., followed her lead in every possible way, that the information about her pregnancy would not go beyond the institution AK 159/1. At night, on September 12-13, 2016, they were the ones, who gave instructions regarding the meeting between convicted Zenina O.V. and convicted Temiryaev V.G. at the office of the operational department of the institution AK 159/1. However, in the course of the pre-trial investigation, these officials were taken out of the criminal case by the own security department of the Department of Internal Affairs in Karaganda region. I’m asking you personally to objectively investigate this criminal case so that all the guilty will be punished. My brother was made a “whipping boy” without thinking that he didn’t have the authority to take the convicted person out of the cell at night,” Kalmychenko wrote.
However, the Prosecutor General’s office refused to consider this appeal for the simple reason that it was done with violations.
“Your question was left without consideration due to non-compliance with the terms of the User Agreement. We draw your attention to the fact that appeals, which are related to criminal, civil or administrative cases, as well as on conducting inspections, taking prosecutorial response measures, clarifying legal norms, in compliance with article 6 of the Law of the Republic of Kazakhstan “On the procedure for considering appeals of individuals and legal entities” (which provides requirements for a written appeal, video address and video conferencing, which must be signed by an individual or a representative of a legal entity), are submitted to the prosecution authorities of the Republic Kazakhstan purposely, through the post service or electronic portal. To send an appeal to the electronic portal, you must have an electronic digital signature, which can be obtained at the Center for Public Services at the place of residence,” the prosecutor’s response said.
At the beginning of 2020, five employees of AK 159/1 were dismissed for negative reasons. Two of them are the deputy head of the pre-trial detention center, Sairan Kamzabekov, and the inspector of the personnel policy group of the institution, Azamat Tleugabylov. They were also prosecuted for organizing the meeting with a prisoner, who was sentenced to 5.5 years in prison, for $300.
