The PF “Adilet Legal Clinic” addressed an open letter to the Prime Minister of Kyrgyzstan, Muhammedkaly Abylgaziev, and the Mayor of Bishkek, Aziz Surakmatov.
“During the past few days, the leaders of the government and city hall of Bishkek voiced ambiguous and contradictory requirements for the work and movement of citizens. The government has only authorized certain types of activities, which means a ban on all others. This is a serious limitation of human rights, permitted, in strictly specific cases. However, according to the legislation, such restrictions can be introduced only on the basis of relevant legal acts. Unfortunately, to date, neither the media nor the sites of authorized bodies have published relevant documents,” the statement notes.
In addition, according to lawyers, the documents, that establish requirements for presenting certificates of residence, route sheets and certificates of employment (certified by the State Tax Service), have not been published. It quite reasonably caused a negative reaction from the society.
“The authorities have repeatedly denied their own public statements, which indicates the absence of approved documents on these issues. All these circumstances will inevitably lead to violations of human rights, because it turns out that both the population and government agencies don’t know what specific rules must be observed. Under such conditions, police patrol units may unlawfully fine citizens for the lack of various certificates. In this way, favorable conditions are created for arbitrary practice of applying the law and corruption,” the Adilet Legal Clinic notes.
Lawyers urge public authorities to restore at least the minimum level of managerial and legal culture; in order to strictly observe the Constitution and Laws of Kyrgyzstan, to establish fair requirements for work and movement of citizens.
