Today, on May 8, the President of Kyrgyzstan, Sooronbai Jeenbekov, signed the law of the Kyrgyz Republic “On amnesty in honor of the 75th anniversary of the Victory in the Great Patriotic War of 1941-1945 and the 10th anniversary of the People’s April Revolution of 2010”.
Earlier, on April 30, the law was adopted by the Parliament of the republic.
“The law was adopted regarding the declaration of amnesty because of respect for universally accepted human rights and freedoms, in order to implement the principles of humanism and mercy, in connection with the 75th anniversary of the Victory in the Great Patriotic War and the 10th anniversary of the People’s April Revolution of 2010,” press service of the head of state informs.
According to part 1 of article 1 of the law, persons, who shall be exempted from criminal punishment in the form of imprisonment for crimes, are the following:
- men over 60 years old and women over 55 years old;
- persons with disabilities (groups I and II);
- persons who are the sole breadwinners in the family, who have at least two minor children or children with disabilities (groups I and II);
- persons who have committed less serious crimes for the first time;
- women who are single mothers;
- women with many children;
- women and minors whose unserved part of the sentence is less than one year on the day this law enters into force.
At the same time, the list of crimes is defined for which the actions of paragraph 1 of article 1 do not apply.
It is noted that for people with diseases that pose a danger to others (tuberculosis, infectious diseases, sexually transmitted diseases), amnesty will be applied after they complete the necessary course of treatment.
“The bill provides that the decision to apply or not to apply the amnesty act is taken individually for each person,” the document says.
According to the information of the State Penitentiary Service on April 7 of the current year, the number of special contingent in the penitentiary system is 9542 people, 1606 of them are accused, 7939 people are convicted.
“According to preliminary information, on basis of the analysis, about 2500 prisoners are subject to amnesty. The list of persons, who fell under the amnesty in the first place, included those who committed the crimes for the first time, for not serious crime, women with many children and those who have minor children, as well as men over 60 years old and PWD of 1-2 groups,” said Tokon Mamytov (Ombudsman of Kyrgyzstan) to ACCA.
He stressed that the last time the amnesty was carried out in the country about 5-6 years ago and its need has ripened long ago. In this connection, the decision of the President and the Parliament, regarding the amnesty, found support from human rights defenders, NGOs and the Institute of Ombudsman.
The law comes into force from the moment of official publication and is subject to execution within 6 months.
