In Kazakhstan, the most famous special prosecutor is suspected of torture

The Ministry of Internal Affairs of Kazakhstan is conducting a pre-trial audit against the former head of the fourth Service of the General Prosecutor’s office (Special Prosecutor’s Service) Olesya Keksel and the member of the investigative-operational group of the General Prosecutor’s office Baurzhan Gabbasov. The reason for the audit was the statement of businessman Erlan Nabiev, who is one of the defendants in the case of theft and embezzlement of more than $1.14 million in 2015.

Today, the attention of the whole country is riveted to the trial of businessman Nabiev, because, in addition to the businessman, two former senior officials [the vice-minister of energy of Kazakhstan Anatoly Shkarupa and the chairman of the board of the Housing and Utilities Development Fund JSC Kaisar Baidaly] also appeared on the dock.

All three defendants, if their guilt is proved in court, faces up to 12 years in prison.

Shkarupa, Baidaly and Nabiev were arrested in November 2018 on suspicion of embezzlement of the budget allocated to the Housing and Utilities Development Fund for the acquisition and installation of heating counters in the city of Sarani (Karaganda region).

But, as the Prosecutor General’s office found out, in Sarani at that time there was no heating main and central boiler room. Anatoly Shkarupa, who at that time held the post of mayor of Sarani, knew this very well. Nevertheless, according to investigators, the three defendants purchased heating counters and installed them into empty walls, reporting to the government for the disbursement of funds.

Investigators of this case were from the Prosecutor General’s office. Including, judging by the statement of Nabiev, Olesya Keksel was also involved.

The name of the former head of the Office of Special Prosecutors, Olesya Keksel, is widely known in Kazakhstan. Few of the prosecutors managed to make such a breathtaking career, especially woman. Keksel graduated with honors from the Financial Police Academy. She began her career as an investigator. Then she became Deputy Head of the Investigation Department of the National Bureau of Anti-Corruption. In January 2018, she led the Office of special prosecutors.

It was Keksel who investigated the most high-profile corruption cases of recent years in Kazakhstan. Such as the case of the former Minister of Health Zhaksylyk Doskaliev (in August 2011, he was convicted of bribery for 7 years, but was released on parole in March 2012), or the former Prime Minister of Kazakhstan Serik Akhmetov (convicted of corruption in 2015 to 10 years; in 2016, the term was reduced to 8 years, and in 2017 on the occasion of the amnesty he was replaced with the unserved part of the sentence with restriction of liberty), or the case of the former Minister of National Economy Kuandyk Bishimbaev (sentenced to 10 years in March 2018 for corruption).

For her work, Keksel was awarded the state order “Aybyn” II degree and recognized as “Civil Servant of the Year” in 2017. In addition, she was awarded the title of Senior Counselor of Justice.

However, in May 2017, it became known that Keksel voluntarily quit and left Kazakhstan; it seems to have moved to Germany.

And at the preliminary hearings in Sarani concerning the case of Nabiev, Shkarupa and Baidaly, it became known that a torture allegation had been filed against Keksel. According to entrepreneur Nabiev, Keksel and Gabbasov applied psychological measures and threats to him, did not give him food or drink, demanding to criminate himself and other persons involved in this case.

Meanwhile, the Ministry of Internal Affairs of Kazakhstan reported that Olesya Keksel did not move to Germany and is in Kazakhstan. This was announced today by the Minister of Internal Affairs of the Republic Erlan Turgumbaev.

“A statement was received from a citizen who stated that during the investigation he was allowed to engage in unlawful methods of investigation, to coerce to testify by the former head of the Criminal Prosecution Service of the General Prosecutor’s office, Olesya Keksel. Therefore, this statement has been registered, and an investigation is being conducted into unlawful methods of investigation. No charges were brought against Keksel, no preventive measure was taken, she is not hiding from investigative actions,” the head of the department said.
