The Ombudsman of Kyrgyzstan, Tokon Mamytov, was approached by a man who complained about the delay in the trial of the Oktyabrsky District court of Bishkek by the judge, where he is being held as a defendant in a criminal case.
When studying the complaint, it became known that the trial began on February 19, 2019. The next session, scheduled for February 26, did not take place due to the absence of the prosecutor, then four more sessions were adjourned due to the lack of witnesses, and the sessions scheduled for April 8 and 15 were rescheduled due to the absence of the prosecutor.
The next two sessions, which were to be held on May 27 and June 11, did not take place due to the judge’s prolonged illness. After that, two more sessions were adjourned due to the lack of witnesses, and on August 29 – again due to the lack of the prosecutor.
“On September 5, 2019, the meeting finally took place, where they interviewed one witness – the investigator. But already the next sessions on September 11 and 23 were deranged due to the lack of witnesses, and on September 24 – again due to the judge’s illness. On October 3, the meeting took place… one witness was interviewed – a citizen. And, according to the scheme that has already become usual for the Oktyabrsky court, the next two court hearings on October 17 and 18 were postponed, but now because of the prosecutor’s illness,” the Ombudsman’s office said.
Thus, during eight months, only 6 out of 25 scheduled court hearings were held.
At the initiative of Tokon Mamytov, members of the Department for work with the judicial bodies will monitor the judicial processes of the Apparatus. The question is taken under the control of the Ombudsman.
