Kyrgyzstan: the court sent the accused with a serious diagnosis under arrest

The judge of the Pervomaisky District Court decided to detain the accused despite the fact that he became ill in the courtroom.

Earlier, ACCA wrote that the investigator of the Service for Combating Illicit Drug Trafficking of the Ministry of Internal Affairs of the Kyrgyz Republic Ibragim Mukhamedov, despite the diagnosis confirmed by the medical report of the accused M. Zhiyanov, refuses to change the measure of restraint on far-fetched grounds. Zhiyanov’s lawyers told ACCA about this.

On Friday, the Pervomaisky District Court decided to detain M. Zhiyanov, accused of distributing narcotic drugs. The investigating judge Ibraimov N. made a decision despite the fact that the accused became ill right in the courtroom. In order to stabilize Zhiyanov’s condition, an ambulance was called to the courtroom.

“Despite the fact that the ambulance arrived and recorded the serious condition of the accused, the court left him in custody until September 7,” Zhiyanov’s lawyer told ACCA.

On August 1, lawyers Samat Matsakov and Kubanychbek Tumanov filed a petition with a request to change the preventive measure from detention to non-custodial for their client M. Zhiyanov due to his serious condition. Zhiyanov’s illnesses are included in the list of serious illnesses that prevent the detention of suspects and defendants.

In May of this year, during a search of Zhiyanov’s car, matchboxes with cannabis were found. On this fact, a criminal case was initiated under Part 1 of Article 282 “Illegal manufacture of narcotic drugs, psychotropic substances and their analogs for the purpose of sale.”
