Gafurzhan Dadazhanov has been trying to restore justice and return the illegally taken property of his family for 12 years. Together, law enforcement agencies are in no hurry to bring the perpetrators to justice. Supervisory authorities send case files from one department to another.
A land plot of 3.1 hectares, owned by Dadazhanov on a private basis, located in the Zulpuev rural administration of the Osh region, was seized by a group of people on July 1, 2010. According to the victim, they were led by the head and employee of the village council, as well as an expert in the architecture of the Nookat region.
A fattening complex for animals was built on the site, fruit trees were planted, and a garden was planted. After the capture, the cattle were stolen, fruit-bearing trees were cut down, and the land was divided into 33 parts and given for the construction of individual residential buildings.
Before the incident, according to Gafurzhan Dadazhanov, young people came to his house demanding to sell the plot, they threatened, insulted, and humiliated him. And the watchman of the site and a friend of the family were even beaten.
“Mamasali Narbaev, the head of the Zulpuyevo village council, Zhenish Abduvapov, an employee of the village council, and an architect from the Nookat region were involved in the crime,” Dadazhanov said in his appeals.
A criminal case was initiated on the fact of the seizure of property, but there was no result – Dadazhanov cannot use his property as people live there. Investigators of the Nookat District Department of Internal Affairs stopped the criminal case several times. Also, the district prosecutor’s office for a long time tried to take away the property from the owner, but Dadazhanov won all the courts.
At the end of November 2021, Gafurzhan Dadazhanov appealed to the Prosecutor General’s Office and the President of the country with a request to prosecute land occupiers and compensate for the damage caused. The Prosecutor General’s Office sent the case to the Osh Regional Prosecutor’s Office. However, this did not give results.
As a result, in July of this year, Dadazhanov again filed a complaint with the President of the country, the Ombudsman and the Prosecutor General. He said that despite his repeated appeals, the case is not resolved. As soon as he applies for the protection of his rights, local government agencies begin to check his activities, trying to challenge the legality of his right to ownership. The local authorities do not seek to return the land to the family. In his statements, Dadazhanov asks to take the case under control, bring to justice those involved in the seizure, and return the property to the rightful owner.
