Kyrgyzstan: police officers, who were guilty of death due to torture, escaped imprisonment

The trial has ended in the court of first instance on the case of the death of Muhammad Kanibek uulu from torture. The defendants, the policemen, were found guilty, but their real terms of imprisonment were replaced by probation.

 In court, the defendants asked for acquittals. The prosecutor asked to appoint five defendants 9 years and 3 months each and the sixth defendant – 7 years in prison. The court found six defendants guilty.

One defendant was sentenced to 2 years in prison, the sentence was changed to probation for 1 year. The other five defendants received sentences ranging from 9–9.6 years in prison, but the punishment was replaced by probation for a period of 4 years each. As a result, all the defendants were released from the courtroom on the day of the announcement of the verdict.

In 2022, the Regional Prosecutor’s Office in Osh filed an appeal against the verdict, stating that the judge illegally replaced the serving of the sentence with probation supervision.

“Probationary supervision is not applied to state and municipal employees guilty of abuse of official position, including under the article ‘Torture’,” the document says.

It’s worth recalling that Mukhammed Kanibek uulu died a few hours after his arrest on the night of October 15-16, 2020. On November 19, 6 employees of the Internal Affairs Directorate of Osh region and Kara-Suu district were detained. The case was transferred to the City Court of Osh in May 2021.
